MINUTES

The regular scheduled meeting of the Pooler City Council was held on

February 15, 2010. Mayor Mike Lamb called the meeting to order at 6:00 p.m. Present were Councilwoman Rebecca Benton, Councilwoman Shannon Black, Councilman David Burke, Councilman Mike Royal and Councilman Stevie Wall. City Manager Robbie Byrd and City Attorney Steve Scheer were also present. Councilman Bruce Allen was absent due to work.

The invocation was given by Councilwoman Benton and the Pledge of Allegiance was led by Councilman Burke.

The minutes of the previous meeting were approved as printed upon a motion by Councilwoman Benton, seconded by Councilman Royal, with no opposition.

Report from the Standing Committees:

FINANCE

Councilman Burke presented the accounts payable information for the month of February, making a motion to pay the bills in excess of $1500.00. Motion was seconded by Councilwoman Benton and passed without opposition.

PUBLIC SAFETY

Councilman Royal stated that the police department responded to 942 calls from January 29^th through February 11^th, with a total of 3230 calls for the year. Further, that the fire department responded to 74 calls this month. Fire Chief Wade Simmons reported that the 911 committee has been re-formed to address the residents’ concerns over emergency services.

PARKS &TREES/STREET/DRAINAGE

Councilwoman Benton reported that the parks & trees, street and drainage departments performed routine maintenance. Further, that Mr. Byrd has been working on the lighting project on Pooler Parkway, requesting that this work continue further.

WATER/SEWER

Councilman Wall reported that the water and sewer departments performed routine maintenance and that all parameters are being met at the wastewater treatment plant.

RECREATION

Councilwoman Black reported that youth basketball games continue six (6) days a week and that registration for the men’s industrial softball league will continue until March 26^th.

BUILDING/ZONING

Councilman Allen was absent. Zoning Administrator Jackie Carver stated that seven (7) new single family residential and two (2) commercial permits have been issued since the last meeting, totaling 23 single family and six (6) commercial permits for the year, with 338 inspections performed.

Mayor Lamb read aloud a proclamation in regards to Arbor Day being February 19^th in the City of Pooler.

There was no OLD BUSINESS to discuss.

Under NEW BUSINESS the following was discussed:

1. Requested zoning map amendment of 820 W. Highway 80 (315' depth) from R-1A to C-P

A public hearing was held prior wherein no opposition was presented. Councilman Wall made a motion to approve the zoning map amendment, contingent upon a 20' arboreal landscaped buffer be maintained on the property for protective screening of adjacent residential property and, based on the safety, health and welfare of the public, to exclude a bank, a plaza and any drive-thru drug store, as recommended by Planning & Zoning in 2008. Motion was seconded by Councilman Burke. Discussion followed wherein Mr. Scheer stated that he would like time to determine the definition of “plaza”. Therefore, Councilman Wall withdrew his motion; Councilman Burke withdrew his second. Councilman Wall then made a motion to table this item. Motion was seconded by Councilman Burke and passed without opposition.

2. Approval of resolution regarding 2009 budget adjustments

Mr. Byrd presented a resolution regarding adjustments to the 2009 budget, stating this is needed to correct overruns in departments but that the total appropriations have not changed. Councilman Wall made a motion, seconded by Councilwoman Benton, to approve the resolution. Motion passed without opposition.

Councilman Wall made a motion to adjourn to Executive Session at approximately 6:30 p.m. to discuss legal matters. Motion was seconded by Councilman Royal and passed without opposition.

February 15, 2010. Mayor Mike Lamb called the hearing to order at 5:45 p.m. Present were Councilwoman Rebecca Benton, Councilwoman Shannon Black, Councilman David Burke, Councilman Mike Royal and Councilman Stevie Wall. City Manager Robbie Byrd and City Attorney Steve Scheer were also present.

The purpose of this hearing was to discuss a requested zoning map amendment of 820 W. Highway 80 (315' depth) from R-1A (single-family residential) to C-P (commercial-professional). Scott Fletcher, on behalf of the owner, Sandra Glick, presented a request to rezone Lot A, Durden Subdivision to a depth of 315' from R-1A (single family residential) to C-P (commercial-professional), stating that in 2008, a request to re-zone the property to C-1 (light commercial) was denied, with Planning & Zoning recommending C-P zoning (with conditions). Mr. Byrd stated that 20' of the rear portion of the property is to remain a landscaped buffer, leaving a depth of 295' to be developed. Councilman Wall questioned whether there was access to Highway 80 (curb cut) wherein Mr. Fletcher replied that access would be through Durden Drive. Councilman Wall asked if the petitioner was in agreement with the conditions Planning & Zoning had recommended in 2008 to exclude a bank, plaza or drive-thru drug store. Mr. Fletcher stated that the owner does not agree with the exclusions.

There being no further discussion, the hearing was adjourned at approximately 5:54 p.m.
